Requested Agenda Item Description: The Views @ 5600 LLC owns real property at approximately 5622 South 5600 West, Kearns, Utah in Salt Lake County, Utah, Parcel No. 20-14-232-006. On August 21, 1986, Salt Lake County recorded a perpetual retention pond easement affecting the Property “for the purpose of constructing a retention pond.” On May 8, 1987, the County recorded a perpetual easement affecting the Property which gave the right to “[a]ccess for the purpose of inspection, operation, maintenance, cleaning, removal, and replacement of a storm drain pipeline, detention pond and appurtenant parts thereof for flood control etc.” The County never constructed a retention pond on the Property. In 2019, UDOT retained a perpetual drainage easement for a detention pond on the Property in nearly the same location.  The owner has asked the county to release and quit-claim any interest it may have in the Retention Pond Easement and the Access Easement.  The release of the 5600 Easements should not have any impact on UDOT’s retained easement. Owner has agreed to pay $150.00 for the release of the Easements. The County has determined that it has no current or future need of the 5600 Easements. The release of the 5600 Easements will be in compliance with all applicable state statutes and county ordinances.
