Description:  Salt Lake County owns multiple parcels of real property located at approximately 4215 South 1300 East in Millcreek, Utah, and known as Big Cottonwood Regional Park. Mt. Olympus Improvement District owns and operates a major sewer trunk line and other appurtenances in the Park. The County granted an easement to the District’s predecessor in interest to install and maintain the Sewer Line, but the Prior Easement was previously terminated, and a new easement was apparently never recorded. Based upon the Prior Easement, the District’s predecessor in interest installed and has maintained the Sewer Line in the Park. To clean up the record and acknowledge the existence of the Sewer Line, the District and the County would like to record a perpetual easement to allow for ongoing operation, repair and maintenance of the Sewer Line. Because the Sewer Line was installed pursuant to the Prior Easement, no consideration is necessary for the new perpetual easement, which is intended to officially document on the record the location of the Sewer Line and set forth the rights and obligations of the parties.  The County and the District have prepared a Sewer Line Easement Agreement attached hereto as Exhibit A, wherein the County grants a perpetual sewer line easement across the Park to the District.
