Requested Agenda Item Description: The Utah Legislature enacted H.B. 81 during the 2025 Legislative Session, which legislation prohibits adding fluoride to public water systems and disallows a political subdivision of the state, including Salt Lake County, from enacting or enforcing any ordinance that requires or permits the addition of fluoride to a public water system. This prohibition applies to Salt Lake County Ordinance Chapter 9.26, which was approved by Salt Lake County after an election of Salt Lake County voters in 2000 authorizing the fluoridation of public water supplies in the county. Accordingly, legal counsel recommends the repeal of Chapter 9.26 prior to the May 7 effective date of H.B. 81.
