Title

Consideration of a Resolution of the Salt Lake County Council Authorizing the Conveyance of an Interest in Certain Real Property Located in Murray, Utah by Quitclaim Deed

Body

Requested Agenda Item Description: In 2010, Salt Lake County conveyed certain real property at approximately 882 West GreenOak’s Drive, Murray, Utah, identified as Parcel ID No. 21-14-401-022, by tax deed to Ramon and Aurelia B. Galvan.  The Property had been listed for sale in 2010 by the County because of delinquent taxes assessed in 2005.  Aurelia Galvan passed away in 2006 and Ramon Galvan passed away in 2009.  It appears that Galvan’s son redeemed or paid the delinquent taxes in 2010, causing the County to issue the Tax Deed to the Galvans. The Galvans’ son, as an appointed personal representative of his parents’ estate, conveyed the Property to Salt Lake Neighborhood Housing Services, Inc., in 2019. In Utah, a deed that names a deceased person as a grantee is void. The Tax Deed was void when it was issued in 2010, and County needs to issue a new quitclaim deed to convey the Property.  To this end, a Quitclaim Deed is attached hereto as Exhibit A. It has been determined that the best interests of the County and the public will be served by quitclaiming any County interest in the Property to Salt Lake Neighborhood Housing Services, Inc.
