First Reading of An Ordinance of the Legislative Body of Salt Lake County, Utah Amending Chapter 2.50 of the Salt Lake County Code of Ordinances, 2001, Entitled “County Constables” in Order to Update Provisions Related to the Appointment of Constables by Salt Lake County Body

 

Requested Agenda Item Description: The purpose of these ordinance revisions is to streamline and update provisions in Salt Lake County ordinance related to the appointment of special function law enforcement officer known as constables. Constables serve legal documents among other functions. Under Utah law, constables must be appointed by counties or municipalities, but have statewide jurisdiction and operate their own, independent businesses. These updates to County Ordinance would make the process for appointing and removing constables clearer and more efficient. These updates also increase the required fees paid by appointed constables and their deputies to more accurately reflect actual costs to the county. The revisions have enhanced oversight provisions and include language that would allow the county to withdraw the authority of constables if the Utah Legislature transitions the appointment constables to the state level. If these ordinance revisions are approved by the Council, legal counsel will bring a separate resolution related to the appointment of constables for new terms in July of 2025 at a subsequent Council meeting.
