Consideration of a Resolution of the Salt Lake County Council Authorizing the Transfer of Elk Run (Moonlight) Park and Elk Run Park from Salt Lake County to Magna Metro Township.

Requested Agenda Item Description: Salt Lake County owns a parcel of real property known as Elk Run (Moonlight) Park, located at approximately 3580 South Mystic Way, Magna, Salt Lake County, State of Utah 84088 (Parcel No. 14-32-129-005), and as further described in the Quitclaim Deed attached as Exhibit A, to the Interlocal Cooperation Agreement between Salt Lake County and Magna attached hereto as Exhibit 1 (“ILA”), which is real property in the public use as a public park; and, the County also owns a  parcel of real property known as Elk Run Park, located at approximately 3712 South Elk Point Drive, Magna, Salt Lake County, State of Utah 84087 (Parcel No. 14-32-153-001), and as further described in the Quitclaim Deed attached as Exhibit B to the ILA, which is in the public use as a public park; and, Elk Run (Moonlight) Park, and Elk Run Park, are collectively referred to herein as the “Parks”; and, the Parks are currently used as parks, but the County has determined that the Parks should be transferred to and administered by the City. An ILA to transfer ownership and maintenance of the Parks has been negotiated between the County and the City, the County desires to formally transfer and convey the Parks to the City, and the City desires to formally take and receive the Parks from the County for the purposes and on the terms and conditions set forth in the ILA and the Quitclaim Deeds a public hearing was held at the County Government Center to discuss the transfer of the Parks by the County to the City; having held a public hearing and having provided notice, the County declared the County Properties available for disposal; t has been determined that the best interests of the County, the City and the general public will be served by authorizing the execution of the Interlocal Cooperation Agreement and the Quitclaim Deeds attached to this Resolution. health, prosperity, order, comfort, and convenience of the residents and businesses of the municipality and County.
